Johan van Laarhoven needs a fair trial on Dutch soil
35 years ago, Johan established his first cannabis-coffeeshop in Tilburg. After his retirement he moved to Thailand, where he was arrested last year. The Bangkok Court sentenced him to 103 years of imprisonment, based on the sale of cannabis in the Netherlands. The Thai Court did not take into account that the sale of cannabis is tolerated and that Johan has never been convicted of any crime in the Netherlands, nor Thailand. All the more disturbing, is that 2 days after the judgment a Dutch judge held that the coffeeshops founded by Johan are a shining example of well-organized, tolerated coffeeshops.

That Johan van Laarhoven is a victim of a failed 'tolerance policy' of the Dutch Government towards the sale of soft drugs, and a highly questionable national and international prosecution policy. Even though the Thai Court held that Johan did not violate any rule or regulation in Thailand, he has been sentenced to 103 years of imprisonment.

The Dutch Government to bring Johan and his wife to the Netherlands, so that they can receive a fair trial on Dutch territory. For this, we demand the Dutch Government to work pro-actively for the immediate transfer of Johan van Laarhoven and his wife.

"Voordat een verzoek om de Thaise straf in Nederland te ondergaan in behandeling kan worden genomen, zal de zaak in Thailand afgerond moeten zijn. Het hoger beroep tegen de veroordeling loopt echter nog. Daarnaast is het aan het OM om te bepalen of het een uitleveringsverzoek wenst te doen. Tot op heden is daarvan geen sprake."

REACTIE VAN DE PETITIONARIS
Beste ondertekenaars,
Allereerst willen wij jullie bedanken voor het ondertekenen van de Justice for Johan petitie. Wij als familie van Johan en Tukta waarderen jullie steun enorm. Zoals jullie weten heeft Filemon Wesselink afgelopen november 23.000 handtekeningen aan de parlementariërs Vera Bergkamp (D66) en Michiel van Nispen (SP) overhandigt. Op hun beurt hebben zij de handtekeningen gegeven aan het ministerie van Veiligheid en Justitie. Dinsdag gaf het ministerie haar reactie op de petitie. Kort samengevat stelt het ministerie dat het niet de schuld van de Nederlandse staat is dat Johan en zijn partner aangehouden zijn. Tevens zullen zij geen enkele actie ondernemen om beide hoofdpersonen in dit verhaal naar Nederland te halen. Gemakshalve rept men niet over het feit dat de Nederlandse Officier van Justitie gevraagd heeft om een onderzoek te starten naar Johan en Tukta. Hoe nu verder? Wij als familie blijven ons volledig inzetten totdat de beerput in deze schandalige zaak open gaat. Dit kunnen wij niet alleen. First of all we want to thank you for signing our petition. We as family of Johan and Tukta appreciate your support immensely. As you know, Filemon Wesseling handed over 23,000 signatures to members of the Dutch parliament Vera Bergkamp (D66) and Michiel van Nispen (SP). In turn they gave the signatures to the Ministry of Security and Justice. Tuesday the Ministry gave its response. Briefly, the Ministry declares that it's not the responsibility of the Dutch state that Johan and his partner were arrested. They will also not take any action to bring the two main characters in this story to the Netherlands. Remarkably the Ministery hasn't spoken about the fact that the Dutch prosecutor asked the Thai to start an investigation.
